When we sell a horse, we may offer a trial period. We also require a $250 non-refundable deposit on the
horse, whether paid in full or making payments, which is a commitment to purchase the horse. The number of days that
we allow is at our descretion. During those days, the "Buyer" would be fully responsible for all care & liability
of the horse. If you decide that you do not like the said horse within those days, then we will return all refundable
payments that have been made back to you. However, the horse must be returned in the same condition as when it was sold.
Upon
conformation of payment in full, Seller agrees to promptly execute all necessary
papers and to take all necessary steps to transfer ownership and registration of the animal(s) to Buyer.
Buyer has
the option to review the condition and health of the horse, including any veterinarian examinations, at Buyers’ expense.
Inherent Risks and Assumption of Risk:
The undersigned acknowledges there are inherent risks associated with equine
activities such as described below and hereby expressly assumes all risks associated with participating in such activities.
The inherent risks include, but are not limited to the propensity of equines to behave in ways such as running, bucking, biting,
kicking, shying, stumbling, rearing, falling, or stepping on, that may result in an injury, harm, or death to person(s) on
or around them. The unpredictability of equine’s reaction to such things as sound, sudden movement, and unfamiliar objects,
persons, or other animals; certain hazards such as surface and subsurface conditions; collisions with other animals; the limited
availability of emergency medical care; and the potential of a participant to act in a negligent manner that may contribute
to injury to the participant or others, such as falling to maintain control over the animal or not acting within such participant’s
ability.
